Nanato Media is a digital marketing and web development agency, Nanato Media LLC, organized under the laws of the State of Texas, USA, with its principal place of business in Austin, Texas, USA.

2. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or the business you represent to use the Site or Services.

3. Description of Services

Nanato Media provides digital marketing services to businesses, including but not limited to: search engine optimization (SEO), website design and development, paid advertising management, AI-powered lead generation and chat/call agents, and related reporting and notification tools (including client dashboards).

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice.

4. Client Accounts and Dashboards

Clients who engage Nanato Media for services may be granted access to a personalized, whitelabel dashboard for viewing leads, reports, and account activity. You are responsible for:

• Maintaining the confidentiality of any login credentials associated with your account or dashboard;
• All activity that occurs under your account;
• Notifying us immediately of any unauthorized access or use of your account.

5. SMS / Text Messaging Terms

By providing your mobile phone number and opting in — whether through a service agreement, onboarding process, or web form — you consent to receive text message (SMS) notifications from Nanato Media related to your account, including but not limited to new lead alerts, referral notifications, and account status updates.

• Message frequency varies based on account activity (e.g., you will receive a message each time a new lead or referral is generated for your account).
• Message and data rates may apply. Charges depend on your mobile carrier and plan.
• Opt-out: You may opt out of receiving SMS messages at any time by replying STOP to any message. You may receive one final confirmation message acknowledging your opt-out.

• Carriers are not liable for delayed or undelivered messages.
• We do not sell, rent, or share mobile phone numbers or opt-in consent with third parties for marketing purposes. Text messaging originator opt-in data and consent will not be shared with any third parties for purposes unrelated to providing the Services.
• Supported carriers include major US mobile carriers; we are not liable if your carrier does not support certain features.

6. Acceptable Use

You agree not to:

8. Client Deliverables and Reports

Reports, dashboards, and lead information provided to clients are intended solely for the client’s internal business use. Clients may not resell, redistribute, or share access to whitelabel dashboards or reports with unauthorized third parties without our written consent.

9. Fees and Payment

Fees for Services are set forth in the applicable service agreement or invoice between Nanato Media and the client. Late or non-payment may result in suspension of Services, including suspension of dashboard access and lead notifications, in accordance with the terms of the applicable service agreement.

10. Third-Party Links and Services

The Site or Services may contain links to third-party websites or integrate with third-party services (e.g., Twilio, Meta/Facebook Messenger, Google). We do not control and are not responsible for the content, privacy practices, or terms of any third-party sites or services. Your use of such third-party services is subject to their own terms and policies.

11. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that leads generated through our Services will result in any particular business outcome, conversion, or revenue.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NANATO MEDIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Provisions relating to intellectual property, confidentiality, limitation of liability, and indemnification shall survive termination.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, USA, without regard to its conflict of laws principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Austin (Travis County), Texas, and you consent to the personal jurisdiction of such courts.
